The use of this site is governed by the policies, terms and conditions set forth below. Please read them carefully. Your use of this site indicates your acceptance of these terms and conditions. Your placement of an order indicates your acceptance of these terms and conditions. Your submittal of any purchase order to Bloom Depot indicates acceptance of these terms and conditions. These terms and conditions shall supersede any subsequent terms or conditions included with any purchase order, whether or not such terms or conditions are signed by Bloom Depot. Bloom Depot reserves the right to make changes to this site and these terms and conditions at any time.
This site is owned and operated by Bloom Depot. Unless otherwise specified, all materials appearing on this site, including the text, site design, logos, graphics, icons and images, as well as the selection, assembly and arrangement thereof, are the sole property of Bloom Depot. All software used on the site is the sole property of Bloom Depot or those supplying the software. You may use the content of this site only for the purpose of shopping on this site or placing an order on this site and for no other purpose. No materials from this site may be copied, reproduced, modified, republished, uploaded, posted, transmitted or distributed in any form or by any means without Bloom Depot's prior written permission.

You agree that you are financially responsible for all of your use of this website (as well as for use of your account or log-in information by others, including without limitation minors living with you). You shall be completely responsible for all charges, fees, duties, taxes and assessments arising out of the use of this website. You agree to comply with all applicable laws, rules and regulations. You agree and represent that you are buying for your own use only, and not for resale.
Bloom Depot in their sole discretion reserves the right to review and refuse fundraising affiliates.
Bloom Depot reserves the right, in its sole discretion, to make any necessary updates, modifications and adjustments at any time without prior notice to product descriptions, warranties and prices, due to errors, product discontinuation, changing costs, new market conditions or any other factor. All prices are subject to all applicable sales taxes, handling charges and shipping charges.
In the event a product is listed at an incorrect price due to typographical error or error in pricing information received from our suppliers, Bloom Depot shall have the right to refuse or cancel any orders placed for product listed at the incorrect price. Bloom Depot shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, Bloom Depot shall immediately issue a credit to your credit card account in the amount of the incorrect price.
Your receipt of an electronic or other form of order confirmation does not signify Bloom Depot's acceptance of your order, nor does it constitute confirmation of our offer to sell. Bloom Depot reserves the right at any time after receipt of your order to accept or decline your order for any reason. Bloom Depot reserves the right to not send any gift message that includes profanity, offensive language or hate speech. The sender will not be notified in this case; the message will be destroyed and the order will be shipped with no message attached. Bloom Depot reserves the right at any time after receipt of your order, without prior notice to you, to supply less than the quantity you ordered of any item. Bloom Depot reserves the right to substitute similar product of equal or greater value and/or to make colour substitutions.
Any cancellation or modification of any order must be received by Bloom Depot not later than 48 hours prior to the scheduled delivery of products. Any cancellation or modification of any order for products scheduled for delivery on February 14, Easter Sunday, Mother's Day, Thanksgiving or December 25 must be received by Bloom Depot not later than 7 days prior to the scheduled delivery of products. No returns or exchanges of any delivered products will be accepted.
It is your responsibility to ensure that all shipping information is correct when you submit your order. Bloom Depot takes no responsibility for any undeliverable or delayed orders due to incorrect shipping information. Products will be delivered by means of an overnight courier of Bloom Depot's choosing, either by land or air. It is your responsibility to ensure that someone is present to accept the order when delivered, failing which the order will be left in a location at the discretion of the carrier. Bloom Depot takes no responsibility for any orders that are destroyed, damaged or stolen as a result of the mode of delivery.
Provided that Bloom Depot's care and handling instructions are followed, Bloom Depot warrants that cut flowers will maintain freshness for a period of seven days from delivery and potted plants will maintain freshness for a period of fourteen days after delivery. Bloom Depot will replace any flowers that lose freshness or potted plants that die within the warranty period with fresh product of the same or greater value, in Bloom Depot 's sole discretion. Warranty claims must be made within seven days of delivery for fresh flowers or fourteen days for potted plants by contacting Bloom Depot's customer service department at 1 888 256 6606 or at customerservice[@]bloomdepot.com.
BLOOM DEPOT DISCLAIMS ALL OTHER WARRANTIES AND CONDITIONS, EXPRESS OR IMPLIED, IN RESPECT OF THE PRODUCTS CONTEMPLATED BY THESE TERMS AND CONDITIONS INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. BLOOM DEPOT RESERVES THE RIGHT TO CHANGE ITS WARRANTIES AT ANY TIME, IN ITS SOLE DISCRETION WITHOUT PRIOR NOTICE WITH RESPECT TO FUTURE SALES AND DELIVERIES. SOME PROVINCES DO NOT PERMIT THE EXCLUSION OF CERTAIN IMPLIED WARRANTIES OR CONDITIONS OR LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY OR CONDITION LASTS IN CONSUMER TRANSACTIONS. THEREFORE THE FOREGOING DISCLAIMERS MAY NOT APPLY TO YOU.
IN NO EVENT SHALL BLOOM DEPOT BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING FROM THIS WEB SITE, ITS CONTENTS OR THE PURCHASE OF ANY PRODUCTS PROVIDED ON THIS WEB SITE. BLOOM DEPOT MAKES REASONABLE EFFORTS TO ENSURE THE ACCURACY AND COMPLETENESS OF THE INFORMATION ON THIS WEB SITE. BLOOM DEPOT SHALL NOT BE LIABLE FOR ANY LOSS OR DAMAGE SUFFERED DUE TO INACCURATE OR INCOMPLETE INFORMATION RELATING TO A PRODUCT DISPLAYED IN THIS WEB SITE. You agree that these terms and conditions referred to in this Agreement constitute the entire agreement between you and Bloom Depot pertaining to the subject matter of these terms and conditions, and supersede, terminate and otherwise render null and void any and all prior agreements, understandings, negotiations, contracts, proposals or requests for proposals, whether written or oral, between you and Bloom Depot.
